Introduction

Those in the UK as standard visitors, either as non-visa nationals, using an Electronic Travel Authorisation, or having obtained a visit visa, are not permitted to marry/enter into a civil partnership, or to give notice to do this, whilst in the UK. If you are planning to visit the UK for the purpose of giving notice of your proposed marriage and to get married/enter into a civil partnership in the UK, you are therefore required first to apply for a Marriage Visitor Visa.

Who is eligible for a Marriage Visitor Visa?

  • You must be able to prove that you are a genuine visitor:
  1. It must be your intention to leave the UK at the end of your visit
  2. You must not intend to live in the UK for extended periods of time through frequent or successive visits, nor must you make the UK your main home
  3. You must be seeking entry for a purpose that is permitted by the visitor rules (marriage/entering a civil partnership and giving notice are permitted)
  4. You must not undertake any prohibited activities (work, receive payments for activities undertaken in the UK, study or receive medical treatment)
  5. You must be able to demonstrate that you have sufficient funds to cover all reasonable costs in relation to your visit without you having to work or access public funds.
  • You must be aged 18 or over, and you and your partner must be free to marry or enter into a civil partnership. On arrival to the UK, as it is your intention to marry (and give notice of your marriage), you must hold a valid visa endorsed for this purpose.
  • You must satisfy the decision maker that you intend to give notice of your marriage, and that it is your and your partner’s genuine intention to marry. You must provide evidence of your genuine relationship because a Visa Officer could lawfully refuse your application if they consider that you are seeking entry to the UK to give notice or enter into a sham marriage, or if you are seeking to enter for another purpose.
  • It is not possible to give notice to marry to a wedding registrar in the UK while one party to the proposed marriage / civil partnership is outside the UK. You must therefore wait until the visa is issued, and the overseas party has entered the UK, to give notice in the marriage district where the UK-resident partner normally lives.
  • You must normally give notice at least 29 days before your proposed marriage ceremony, and must marry within 12 months of giving notice.

What documentation do I need to apply?

You will need to provide the following supporting evidence:

  • Valid ID documents
  • Evidence demonstrating that you are in a genuine relationship
  • Evidence relating to your intention to marry or enter into a civil partnership, and to give notice in relation to this
  • Evidence related to your travel plans
  • Accommodation evidence
  • Evidence relating to your ties to your home country
  • Sufficient evidence of your financial circumstances to demonstrate that you can maintain and accommodate yourself during your trip (for example this can include employment evidence, bank statements etc.)
  • TB certificate (if applicable)

How do I apply for a Marriage Visitor Visa?

What is the current decision time for a Marriage Visitor Visa?

The current waiting time for a decision is around 3-4 weeks.

How long will a Marriage Visitor Visa be granted for?

If successful, you will be issued a UK Visit Visa which will be valid for a period of six months. You will be expected to give notice, then marry or enter into a civil partnership in the UK during this period and then return to your home country. A multiple entry visa may be issued by border officials where there will be a delay between giving notice and the date of the wedding/civil partnership. This is up to the discretion of the border officer.

Can you switch to a Partner / Spouse Visa from a Marriage Visitor Visa?

No, you must leave the UK and apply for appropriate entry clearance to the UK as a partner. You cannot extend a Marriage Visitor Visa or switch to another visa. This visa is issued only for the purpose of getting married/entering into a civil partnership and/or giving notice to marry in the UK. This makes it different to the Fiancé(e) Visa, which allows an applicant to switch onto the Partner/Spouse Visa route from within the UK once their marriage or civil partnership has taken place.

What am I permitted to do on a Marriage Visitor Visa?

A person who holds a Standard or Marriage/Civil Partnership Visit Visa or permission can transit the UK as well as undertake any of the other permitted activities in Appendix Visitor: Permitted Activities, with the exception of permitted study under paragraph PA 17, which can only be undertaken by Standard visitors.

You cannot:

  • get public funds (benefits)
  • bring in family members (‘dependants’) - they must apply separately
  • live in the UK for extended periods through frequent visits
  • extend your visa or switch to another visa
  • work - except for permitted activities related to your work or business overseas, such as attending meetings
  • study

 

Is there a priority service available for this type of application?

Depending on the country you are applying from, a priority service may be available for an additional fee. Purchasing this service will put your application at the front of the queue for priority consideration. Most applications that are submitted using the priority visa service are decided within 5 working days of an applicant enrolling their biometric information overseas.
