Latitude Law overcame overstaying challenges to secure a Global Talent Visa for a US theatre designer, ensuring her return to the UK.
The Global Talent visa provides an opportunity for leave to enter or remain in the UK for individuals in the fields of natural and medical sciences, engineering, humanities and social sciences, digital technology, research and innovation, and arts and culture (inclusive of film, television, fashion and design, and architecture).
Applicants can apply under either the āexceptional promiseā category or āexceptional talentā. Exceptional promise refers to those who are potential leaders in their field, whereas exceptional talent refers to those who are already leaders in their field.
If your application is successful, you will be granted leave for the period you requested in your application, up to 5 years. If you wish to stay in the UK for longer, you can apply to renew your visa as many times as you like, provided that you can still meet the eligibility requirements for extending.
Global Talent is a route to settlement. You may be eligible to apply to settle permanently in the UK after 3 years if you are applying as a leader, or after 5 years if you are applying as a potential leader.
Applying for the Global Talent visa is typically a two-stage process. Before you can apply for the visa, you must obtain an endorsement from one of the Home Office approved endorsing bodies. The endorsing body you need to apply to depends on the field in which you work. For fashion design, theĀ British Fashion Council (BFC) will assess your application for endorsement.
Note that if you hold a prestigious prize, you may be eligible to apply for this visa without the need to obtain endorsement. A list of the prestigious prizes can be found here: Immigration Rules - Immigration Rules Appendix Global Talent: Prestigious Prizes - Guidance - GOV.UK (www.gov.uk).

You should include any dependents on your visa application form (Stage 2).
Deciding this can be difficult and there are no strict rules determining what category you belong to. Generally, however, Home Office guidelines confirm that those on the promise route will be in the initial stages of their professional career (with five or less years of experience). If you have been working in your field in excess of five years, you are more likely to fit into the talent category. You should carefully review the document table above to confirm what you are able to provide to support your application. One of our team will be more than happy to discuss the criteria with you to establish which route fits you best.
