Introduction

The Global Talent visa provides individuals in certain sectors an opportunity for leave to enter or remain in the UK. There are several types of Global Talent visa, including for the fields of natural and medical sciences, engineering, humanities and social sciences, digital technology, research and innovation, and arts and culture (inclusive of film, television, fashion and design, and architecture).

For talented and promising individuals working in the arts and culture sector, the Global Talent visa offers a pathway to living and working in the UK. However, it can also be difficult given the requirement to meet strict eligibility requirements and secure an endorsement from a relevant organisation. It is important to work with a solicitor on a Global Talent visa application to give yourself the highest chance of success.

Latitude Law specialises in advising exceptional promise and exceptional talent applicants on the Global Talent route. We can review your application and any supporting evidence, and offer tailored legal advice throughout the application process to help you fulfil the eligibility requirements and secure your visa. Get in touch with our team today to learn more about how we can help by calling 0300 131 6767 or use our online enquiry form to request a call back.

What is the Global Talent visa?

A Global Talent visa allows those with exceptional talent or promise to come to the UK for a specified period. Applicants can apply under either the ‘exceptional promise’ category or ‘exceptional talent’ if they work in a the arts and culture sector (or another relevant sector as listed above). Exceptional promise refers to those who are potential leaders in their field, whereas exceptional talent refers to those who are already leaders in their field and who meet specific exceptional talent criteria. For the Arts and Culture visa, the relevant fields are:

  • arts;
  • dance;
  • literature;
  • music;
  • theatre; and
  • visual arts.

You will need an arts and culture endorsement when you apply, which involves proving that you meet the exceptional promise or exceptional talent criteria.

If your application is successful, you will be granted leave for the period you requested in your application, which can last up to five years. If you wish to stay in the UK for longer, you can apply to renew your visa as many times as you like, provided that you can still meet the eligibility requirements for extending.

Global Talent is a route to settlement. You may be eligible to apply to settle permanently in the UK after three years if you are applying as a leader, or after five years if you are applying as a potential leader.

Who is eligible for the Global Talent (Combined arts, dance, literature, music, theatre or visual arts) visa?

Applying for the global talent visa is typically a two-stage process. Before you can apply for the visa, you must obtain an endorsement from one of the Home Office approved endorsing bodies. The endorsing body you need to apply to depends on the field in which you work. For this field, Arts Council England will assess your application.

To be eligible in this field, you must satisfy the endorsing body that you have either been recognised as an exceptional talent, or that you are someone with exceptional promise and

  • You are professionally engaged in producing outstanding performed, presented, distributed or internationally exhibited work, and
  • You have shown regular professional engagement in your field in the last 5 years, and
  • If evidencing exceptional talent

i.   You can show a substantial track record in at least 2 countries.

If evidencing exceptional promise

i.   You are at any early stage in your career; and

ii.   You show a developing track record in 1 or more countries.

Evidence such as international media recognition or international awards can serve to demonstrate that you fulfil these requirements, but it can be more difficult without this evidence. Latitude Law can advise you on the types of documents you can supply that will be suitable for a Global Talent application.
