Tier 1 Entrepreneur settlement cases with high absences & staggered application dates for dependants

The Challenges Faced

Client A, a Jordanian business owner, relocated to the UK with his family on Tier 1 Entrepreneur visas secured by Latitude Law in 2018/9. He founded an IT business, which saw significant growth. The family sought settlement in 2023, but faced challenges due to excessive absences and staggered eligibility dates for dependents who arrived later. A Covid-related concession for absences was available, but Client A preferred to avoid it to prevent additional steps in the settlement process. Evidence for medical grounds for certain absences was needed, and initial assessments suggested low prospects for settlement, prompting exploration of alternative routes like Skilled Worker visas, which were not ideal for the client.

How Latitude Law Helped

Latitude Law gathered evidence for medical grounds for absences, demonstrating deep knowledge of settlement guidance. We secured a sponsor licence for Client A’s business as a fallback option and provided advice on the genuine entrepreneur requirements for Client A’s settlement interview. For dependents, we prepared short-term extension applications, to be varied to settlement at the appropriate time.

The Outcome

Client A’s settlement application proceeded with tailored interview advice, while dependents’ extension applications were successfully submitted, pending conversion to settlement. Through careful, holistic advice and risk management, including fallback options, Latitude Law effectively managed the clients’ expectations in these complex cases.
