The Challenges Faced

Client A and Client B, two domestic workers, played a vital role in raising the three children of the C family while living in Hong Kong. When Mr. C’s UK employment was extended, retaining their services became critical but was not permissible under current Immigration Rules, presenting a significant legal barrier.

How Latitude Law Helped

Latitude Law advised the C family on retaining Client A and Client B, exploring sponsorship through a skilled worker route via a sponsor licence application for a special purpose vehicle. Due to challenges with this option, we pursued applications based on human rights and the best interests of the children, supported by evidence from a clinical psychologist. When the Home Office refused the applications, we mounted a judicial review challenge.

The Outcome

The case remains before the courts, with arguments centered on the established bonds between the domestic workers and the children, bolstered by key psychological evidence.
