Can I make my visa application from inside the UK?

If you can’t leave the UK due to Covid-19, then in some circumstances, you may be eligible to make an application for leave to remain from inside the UK. You must show that your application is urgent (i.e. you need to start work or study) or that you have received exceptional assurance. If your application is not urgent and you have not received exceptional assurance (for example because your visa expires after 28 February) your application may be refused. If you are not sure if your application is urgent, please contact our specialist team for advice.

You can apply online and will need to pay the application fee. You will also need to meet the requirements of the route you are applying for. The terms of your leave will remain the same whilst you wait for a decision on your application. You’ll need to meet the requirements of the route that you are applying for in order to switch to the route successfully.

If your visa is expiring before 30 June 2021 and you cannot leave the UK, you can request additional time to stay in the UK, known as ‘exceptional assurance’. This is not a grant of leave, but will permit you to stay in the UK for the additional time until you are able to leave the UK. During the time in which your request for ‘exceptional assurance’ is pending you will continue on the conditions as per your current or most recently expired visa.

You are also able to apply for permission to stay to remain in the UK if you have been previously issued with an ‘exceptional assurance’. You must submit your application before the expiry of your ‘exceptional assurance’.

If you are unsure about whether you can meet those requirements, speak to one of our team of specialist immigration advisors.
